A listing that came on the market this year at 22909 Eagle River Road included a document most buyers never think to ask for: a shared water well agreement between two neighboring lots in the Glacier View Heights subdivision. The owner of one lot gets access to a well physically located on the other, through a ten-foot easement, with pump and engine costs split down the middle. Nothing about the water was wrong. The house wasn't failing an inspection. What made the file thick wasn't the well itself, it was documenting who is actually responsible for the pipe that carries the water to the door.

That's the pattern worth understanding if you own, or plan to buy, a well-and-septic home in Eagle River. The system usually works fine. What derails a closing date is rarely a bad well or a failing tank. It's paperwork that has a shelf life, and nobody told you it was ticking.

The Ordinance Nobody Reads Until They Need It

Since August 18, 1998, the Municipality of Anchorage has required a Certificate of On-Site Systems Approval, known in the industry simply as a COSA, before title can transfer on any property served by a private well or an on-site septic system. The rule lives in Anchorage Municipal Code 15.65 and applies to nearly every sale within municipal limits, with narrow exceptions for transfers between spouses or into a family trust.

The idea behind it is straightforward. A registered civil or environmental engineer inspects and tests the well and septic system, confirms both meet current municipal standards, and certifies the results to the municipality before the sale can close. Mat-Su Borough, just up the road, has no equivalent requirement. It exists because Anchorage decided, nearly three decades ago, that a home changing hands is the moment to confirm the water is safe and the wastewater system is working, not the moment to find out it isn't.

That much is well documented and easy enough to find in the code itself. What's harder to find, and what actually determines whether your closing date holds, is what happens after the engineer shows up.

The System Almost Never Fails. The Calendar Does.

Here's the part that catches sellers off guard. A COSA isn't a single pass-or-fail test. It's a bundle of separate results, each with its own expiration clock, and the municipality requires every piece to be current on the day the certificate is issued. A home can have a perfectly healthy well and a septic system in excellent working order and still fail to produce a valid COSA, simply because one piece of paperwork aged out while the rest of the file was being assembled.

The clocks run at different speeds:

The 90-day window is the one that trips people up. Bacteria and nitrate results have to be less than 90 days old at the time the municipality reviews the file. If your engineer pulls that sample early in the process and your closing slides for any reason, financing delays, an appraisal hiccup, a buyer asking for more time, that sample can expire before the paperwork is even submitted. Nobody's well got worse. The clock just ran out.

This is why the smart move for a seller isn't to start the COSA process the week you list. It's to sequence it so the fastest-expiring tests happen last, close to the actual closing date, rather than first.

Where This Actually Matters in Eagle River

Not every Eagle River address needs to worry about this. Homes inside the AWWU service boundary, generally the areas closer to the town center along Eagle River Road, draw municipal water sourced entirely from the Eklutna Water Treatment Plant and connect to public sewer. No well, no septic, no COSA.

The requirement matters most in the pockets built on larger lots outside that boundary: Fire Lake, the corridor along Eagle River Valley Road heading toward the Chugach foothills, and outlying stretches of Eagle River Estates where development predates dense municipal utility buildout. Peters Creek, just north along the highway corridor, follows the same pattern. These are exactly the areas where buyers are often drawn by acreage, tree cover, and direct trail access, and exactly the areas where the well-and-septic conversation needs to start earlier in the process than most people expect.

The Other Way This Gets Expensive

There's a second, less common but more costly version of this problem, and it shows up in older homes that were finished in stages. A septic system is sized and approved based on the number of bedrooms it was originally designed to serve, not the number of bathrooms or the square footage. If a home was built with an unfinished lower level that got finished later into two or three additional bedrooms, the septic system on file with the municipality may still be approved for the original, smaller bedroom count.

The system can have worked fine for years. It can still fail an adequacy test simply because it's being asked to serve more bedrooms than its original design and permit account for. When that happens, the fix isn't a quick fix. A new system, sized correctly and installed to meet current code, commonly runs in the $8,000 to $15,000 range for a straightforward site with cooperative soil, and higher where the ground itself, clay, boulders, or a high water table, requires a more complex design. That's not a delay measured in days. It's a delay measured in a full design, permit, and construction cycle, which is exactly why engineers recommend testing early rather than waiting for an offer to force the timeline.

Who Does This Work, and What It Costs

The process itself is narrow enough that it has to be done by specific licensed professionals, and Eagle River has its own base of firms that handle it regularly. If you're preparing to list a well-and-septic home in Eagle River, a few things worth doing well before you sign a listing agreement:

  • Pull your septic pumping receipt and confirm it's less than a year old, or schedule pumping now.
  • Ask your engineer to sequence the bacteria and nitrate sampling as late in the process as the timeline allows, since that's the 90-day clock.
  • If your home has been added onto or finished in stages, confirm the bedroom count on file with the municipality's on-site records matches what's actually built.
  • Locate your as-built survey if you have one. If the system hasn't changed since a prior sale, the municipality may already have one on file, which saves time and cost.

A Few Direct Questions

Who is responsible for getting the COSA, the buyer or the seller? The seller. Municipal guidance places responsibility for obtaining a valid COSA on the party transferring title, which means it needs to be built into the seller's pre-listing timeline rather than left for the buyer's inspection period.

Does this apply if I'm selling to my adult child, or into a trust? The ordinance carves out an exception for transfers between spouses and transfers into a family trust. A standard arm's-length sale to any other buyer, including other family members outside that specific carve-out, still requires the certificate.

Once I have a COSA, how long does it actually stay valid? Two years from the date of the septic absorption field adequacy test or the system's construction date, but only as long as the nitrate and bacteria samples on file stay under 90 days old. In practice, that means a COSA issued today can lapse in less than two years if those two fast-expiring samples aren't refreshed, which is worth knowing if you're not selling immediately but want the certificate ready when you do.

Eagle River's well-and-septic homes aren't a liability. They're simply a different kind of homeownership, one where you're managing infrastructure that a municipal utility handles for homes closer to town. Understanding the calendar behind the COSA, not just the systems it tests, is what separates a closing that happens on schedule from one that slides by weeks over paperwork that had nothing to do with the health of the well or the tank.
